Terms and Conditions

At Over the Moon Vacations, we pride ourselves on providing professional, thoughtful, and honest service to create and facilitate memorable travel experiences for our clients.  Your partnership in the process is important.  To that end, please review & acknowledge our terms & conditions (the "Agreement").  The terms "I', "me", and "my" refer to the individual who signs this agreement.

Services include: consultation time, destination knowledge & advice, custom itinerary creation, recommending accommodations & experiences, booking travel arrangements, access to exclusive preferred partner benefits where applicable, preparing & sending final itinerary & travel documents, in-travel contact & support, and guidance on important elements like entry requirements. 

I understand that Over the Moon Vacations is not the source or supplier of the travel services I have requested, and acts solely as an agent for the suppliers of travel services, including but not limited to: airlines, hotels, transport companies, cruise lines, car rental agencies, and tour operators. I consent to and request the use of those suppliers and agree not to hold Over the Moon Vacations responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience. 

I have received or will receive a summary of charges for the travel services, and I agree that the obligation of Over the Moon Vacations is limited to remitting such charges to the travel suppliers identified in the travel documents or to a third party that shall make such remittance.   

Separate supplier terms and conditions will apply to the reservation and purchase of travel-related goods and services. I agree to abide by the terms and conditions of purchase imposed by Over the Moon Vacations and any supplier, including but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. I understand that any violation of any such supplier’s conditions of purchase may result in cancellation of my reservation(s) or purchase, in my being denied access to any flights, hotels, cruises, or automobiles, in forfeiting any monies paid for such reservation(s) or purchase, and in Over the Moon Vacations debiting my account for any costs Over the Moon Vacations incurs as a result of such violation. I shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of my travel bookings through Over the Moon Vacations.  

Any fees paid directly to Over the Moon Vacations for planning and booking my travel arrangements are not an obligation of Over the Moon Vacations to guarantee the quality or timing of my travel plans. I acknowledge that Over the Moon Vacations is not responsible for, nor will I attempt to hold it liable for, any injury, damage or loss I may suffer on account of any conditions, actions or omissions that are beyond its reasonable control.  

I understand that currency exchange rates fluctuate. Prices are subject to change based upon currency exchange rate fluctuations.  

I understand that travel may involve the risk of a variety of hazards to health and/or safety, including, but not limited to, illness, crime, and terrorism. Travelers assume the risk of all inherent dangers, whether known or unknown, in any way connected to the travel services. 

Over the Moon Vacations shall not be liable for costs, damages, or losses that may result from travel. To assist me in making an informed decision about my destination, I should refer to an objective and reputable source, such as the U.S. Department of State (travel.state.gov).  

For international travel, a passport is required and should be valid for at least six months beyond scheduled return date.  I understand that depending on my destination and nationality, a visa may be required. Additionally, my destination may include requirements for blank pages in my passport for entry. I agree that passport validity, blank pages, and obtaining a visa are solely my responsibility, and I agree not to hold Over the Moon Vacations liable for entry requirements.

For domestic travel, I understand that government-issued identification is required in order to board a flight. I further acknowledge that beginning on October 1, 2021, I must present a driver’s license or another form of identification that complies with the requirements of the Federal Real ID Act. Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. I understand that I am solely responsible for providing accurate information to Over the Moon Vacations. This includes but is not limited to: full passport names & numbers, dates of travel, departure/arrival details, and any pertinent information requested by Over the Moon Vacations.

Any consequences as a result of providing inaccurate information or a failure to provide information are my responsibility, and not the obligation or liability of Over the Moon Vacations.  This includes any fees or penalties incurred, travel delays or cancellations.  

I agree to review all travel documents for accuracy upon receipt and understand that I may contact Over the Moon Vacations if I have any questions. I agree to review all terms & conditions set by the travel suppliers, specifically for change and cancellation of services. 

I understand that Over the Moon Vacations strongly recommends that I purchase travel insurance to protect my trip investment. The purchase of travel insurance does not guarantee a claim will be paid; all claims are subject to review from the travel insurance provider. Over the Moon Vacations will not be held liable for any travel insurance claims which are not paid or denied from any travel insurance provider. Should I choose not to purchase travel insurance, I agree that Over the Moon Vacations will not be held liable for any losses incurred.  

Due to the pandemic, we have spent thousands of hours working on trips that we will never be compensated for due to cancellations or postponements. At this time, we have implemented a $300 nonrefundable planning fee for ALL trips. We will collect this fee on Venmo.

The planning fee cannot be used to skirt the budget minimum, and does not allow clients to use our services if they book hotels using credit card points/airline miles, or corporate rates.

All hotel bookings MUST be made through Over the Moon’s suppliers, and clients are strictly prohibited from booking hotels though AMEX, Chase Travel, Capital One, or similar credit card booking platforms.

The planning fee is based on a per trip/per destination basis. The planning fee will not carry over if you decide to change destinations at a later time. We will request a new planning fee for those types of situations.
